Appoint new member, Christopher Bennett, to the Disability Access Board of Appeals, for a term beginning immediately and ending September 30, 2025.

DISCUSSION:

COMPOSITION AND PURPOSE OF THE COMMISSION

 

The Disability Access Board of Appeals is governed by Chapter 15.04.110 of the City of Napa Municipal Code and similarly consists of five members. The Board considers appeals from individuals aggrieved by a determination made by the Chief Building Official or Fire Code Official in administering or enforcing the requirements under the NMC Chapter 15.04 with respect to “public accommodations or facilities”. Three members must serve concurrently on the Building Board of Appeals. Two members must meet the requirements of a physically handicapped person as defined by the California Health and Safety Code Section 19957.5.

 

The Appeals Board meets on “as called” or on an as-needed basis. There has been no appeal heard by the Board in several years.

 

NUMBER AND TIMING OF VACANCIES INCLUDING SPECIAL QUALIFICATIONS

RECRUITMENT PROCESS

 

There is one vacancy due to the term expiration of Doug A. Weir that was effective September 30, 2023. Doug A. Weir served as a member who meets the requirements of a physically handicapped person as defined by the California Health and Safety Code Section 19957.5 and did not reapply for another term.

 

RECRUITMENT PROCESS

 

The recruitment has been ongoing since the original term expiration and closed on July 19, 2024 following the receipt of two applications.  Recruitment announcements were published on the City’s website, on the City’s social media platforms, in the City of Napa News, posted at various locations at City Hall, Human Resources, and the Community Services building, and sent to the Napa County Library, Napa Valley College, Napa Chamber of Commerce, Napa Valley Unified School District, Napa County Board of Supervisors, Napa County Administration, Napa County Hispanic Chamber of Commerce, Napa Valley Community Housing, Puertas Abiertas Community Resource Center, and Leadership Napa Valley.

 

APPLICATIONS RECEIVED

 

Two applications were received from Christopher T. Bennett and Tracy H. Brock. Christopher T. Bennett applied as a person to serve as a Disability Community Member.

 

Tracy H. Brock did not apply as a person to serve as a Disability Community Member; therefore, staff is recommending the appointment of Christopher T. Bennett to fill the appropriate vacant position.

 

FINANCIAL IMPACTS:

None.

The City Clerk has determined that the recommended action described in this agenda report is not subject to CEQA, pursuant to CEQA Guidelines Section 15060(c).
