Authorize the Parks and Recreation Services Director to execute a Facility Use Agreement with the Napa Valley Unified School District (NVUSD) and Napa Valley Tennis Association (NVTA) for shared  use of the Vintage High School tennis courts at 1375 Trower Avenue at no cost to the City for a five year term, with the option to renew for two additional two year terms; and determine that the actions authorized by this item are exempt from CEQA.

DISCUSSION:

City policy supports coordination with NVUSD and other agencies to meet park and recreation facility needs of City residents, as documented in the City’s 2024 General Plan, as well as the 2010 Parks & Facility Master Plan. These policies promote maximizing community financial resources, avoiding duplication of facilities, as well as providing equitable, nearby access to recreation facilities throughout the City.  

​In order to implement these policies, since 1988, the City has entered into a series of existing cooperative agreements (“Master Agreement”) with NVUSD, by which NVUSD authorizes the City to use NVUSD-owed recreational facilities at approximately 18 school sites, and the City uses these facilities to provide recreational opportunities to the community. Over a 30-year period, there were 11 addendums to the Master Agreement.  The purpose of these addendums was to address site-specific projects such as one-time capital investments to develop new recreation facilities at school sites, as well as annual contributions to NVUSD for maintenance expenses related to sports fields.  In 2019, the City and NVUSD agreed the former Master Agreement needed to be updated and both parties entered into a new Joint Use Agreement (“JUA”).  The JUA was renewed again in 2022.  

In addition to the Master Agreement with NVUSD, the City entered into a separate three-party agreement with NTVA and NVUSD for shared use of the eight upper tennis courts at Vintage High School in 2002 (Agreement #8290).  The facility was mainly utilized by NVTA members and they have also maintained and overseen use of the courts since 1976 after the courts were built using grant funding from the State Beach, Park, Recreation and Historical Facilities Bond Act of 1974.  The facility was also used by NVUSD for the Vintage High School tennis teams and by the City  for community recreational tennis programs.  The agreement has expired.  The City, NVUSD and NTVA have been negotiating a new agreement for the past two years.  

​A few highlights from the new agreement includes the following: 

                     ​The length of the agreement is a 5-year term (with the option to renew for two 2-year extensions).

                     ​NVTA will have access to the eight tennis courts 365 days/year between 8am to 8pm with the exception for the days and times agreed upon bi-annually for the Vintage High School tennis teams.

                     ​NVTA will pay annual license fees, pro revenue fees, tournament fees, and reimburse NVUSD for utility expenses and the estimated annual fees total is $5,460.

                     ​NVTA will pay for maintenance of the courts and the maintenance projects will be subject to NVUSD’s approval. 

                     ​During school hours (Monday-Friday from 8am to 4pm), NVTA members will need to follow all policies and procedures for guests on school campuses including completing a background check, wearing school provided ID badges, and displaying a parking pass in their car.  

                     ​NVUSD will have access to the courts up to 20 days/year for Vintage High School tennis teams.  

                     ​City will have free public access to the tennis courts on Sundays from 3-7pm (or to sunset). 

                     ​City will partner with NVTA and have access to the courts to offer community youth tennis lessons.

FINANCIAL IMPACTS:

The Facility Use Agreement will not have a financial impact on the City.  The community public access to the tennis courts will have no fees charged to the City.  NVTA will be required to pay several associated fees with their use of the Facility.  

 

CEQA:

City staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15301, which exempts the operation, repair and maintenance of existing public facilities.
