Authorize the Public Works Director to execute on behalf of the City amendments to three On-Call Engineering Services Agreements: (1) Amendment No. 1 to Agreement No. C2021-331 with dk Associates, Inc. in the increased amount of $300,000 for a total contract amount not to exceed $800,000, (2) Amendment No. 1 to Agreement No. C2021-411 with GHD, Inc. in the increased amount of $300,000 for a total contract amount not to exceed $800,000, and (3) Amendment No. 1 to Agreement No. C2021-362 with Dokken Engineering in the increased amount of $300,000 for a total contract amount not to exceed $800,000.

DISCUSSION:
On September 21, 2021, City Council authorized the Public Works Director to execute agreements for On-Call Civil Engineering Services with dk Associates, GHD Inc., and Dokken Engineering for a total not to exceed amount of $500,000 for each agreement.
Staff recommends amending these three agreements with dk Associates, GHD, and Dokken Engineering to increase each agreement’s not to exceed amount by $300,000 for a total contract amount not to exceed $800,000, extend the term of each agreement to December 31, 2025, and amend the compensation rates.
Since the effective date of the existing agreements, the firms selected have provided on-call professional Civil Engineering services to the City for various Capital Improvement Program (CIP) projects, including Browns Valley Road Rehab, Westwood Neighborhood, Storm Drain Rehab, the Infrastructure Strategic Plan, among other projects and task orders.
Utilizing on-call contracts is an efficient strategy for the City to complete necessary tasks by bringing in additional resources and expertise as needed. This approach allows us to engage professional consultants that have been selected through a competitive proposal process and improves flexibly to meet workloads and shorten delivery schedules. The engineering firms under these contracts are only paid once a task order is executed and engineering work product is delivered. The proposed Amendments will extend the services available, providing as-needed professional Civil Engineering support for the City’s Capital Improvement Program.
FINANCIAL IMPACTS:
There is no funding required for the proposed action. Payment is made using task orders of a combined amount not to exceed $800,000 over the term of each agreement. The funding source is through individual CIP project accounts that require professional Civil Engineering services.
CEQA:
The Public Works Director has determined that the Recommended Action described in this Agenda Report is not in-and-of-itself a “project” (pursuant to CEQA Guidelines Section 15378) since it does not result in a physical change in the environment.
However, the Recommended Action is part of larger “projects” that will be subject to environmental review in accordance with CEQA at the “earliest feasible time” prior to “approval” consistent with CEQA Guidelines Sections 15004 and 15352. The larger “projects” are various CIP projects, and staff plans to bring back a CEQA analysis of those projects to Council prior to awarding construction contracts.
