Adopt a resolution approving and authorizing (1) the City Manager to execute on behalf of the City, an amendment to Agreement No. C2023-671 with Axon Enterprises, Inc., in the amount of $100,116.92, for a four-year term, to purchase in-car video cameras for Police Department vehicles for a total project amount not to exceed of $1,694,355.35; (2) an appropriation in the amount of $21,657.89 from the Traffic Safety Fund, as documented in Council Budget Amendment No. 513P7

DISCUSSION:
In November 2023, the City of Napa entered into a five-year agreement with Axon Enterprises, Inc. (Axon) for $1,594,238.43 to provide cloud-based Digital Evidence Management through Evidence.com, Taser 10 conducted energy weapons, and body-worn cameras (BWC) for police department employees (C2023-671). The body-worn cameras have maintained high reliability, enabling employees to record interactions with the public, capture evidence, and meet community expectations of accountability and transparency.
The Napa Police Department requests authorization to amend the agreement with Axon Enterprises, Inc., to install and maintain “Fleet 3” in-car video cameras in seven police vehicles for up to $100,116.92. Five of the police vehicles are assigned to traffic enforcement, and two of the vehicles are assigned to patrol operations.
Axon Fleet 3 is an advanced in-car video system designed to capture high-quality audio and video footage during police contacts and enforcement activities, including traffic enforcement. These cameras will support community expectations for accountability and transparency by providing additional points of view during law enforcement activities and support our traffic safety efforts.
Staff recommends that an additional $25,000.00 be included in the project implementation budget to cover hardware and software integration and contingencies for unforeseen conditions for the duration of the agreement.
The project implementation budget is proposed as follows:
Fleet 3 provided by Axon Enterprises, Inc. $ 75,116.92
Contingency and hardware replacement costs (Information Technology) $ 25,000.00
Total $100,116.92
The contingency, hardware replacement, and integration costs are estimates.
With the approval of this agreement, the total services agreement with Axon Enterprises, Inc. is not to exceed $1,694,355.35. The services agreement for Axon Fleet 3 will co-terminate with the existing Axon agreement in 2028.
Staff recommends the City Council determine the proposed additional services with Axon Enterprises, Inc. for Fleet 3 also qualifies as a specialty item under Napa Municipal Code 2.91.050. Findings have been included in the resolution indicating that Axon Fleet 3 cameras are a specialty item best meeting the City’s needs and it would be impracticable to proceed with another service based on the consistency with the City’s existing digital evidence management system held by Axon. Further, Axon is the sole vendor for the Fleet 3 products and services the City seeks to purchase.
FINANCIAL IMPACTS:
There is no fiscal impact on the General Fund. Upon approval, an appropriation in the amount of $21,657.89 from the Traffic Safety Fund account (20321300) will be made as documented in Council Budget Amendment No.513P7 for FY2024/25 expenditures.
Traffic Safety Fund currently has an undesignated fund balance of approximately $302,000. The remaining contract amendment costs of approximately $17,819.67 per year will be budgeted through the normal budget process in future years.
Funding for the remaining balance of the Axon agreement C2023-671 has already been allocated within the city budget (10021306-53250).
CEQA:
The Police Chief has determined that the recommended action described in this agenda report is not subject to CEQA, pursuant to CEQA Guidelines Section 15060(c).
