Title

City of Napa 2026-2028 Biennial Conflict of Interest Code Update

LABEL

RECOMMENDED ACTION:
Recommendation

Adopt a resolution approving the 2026-2028 City of Napa Conflict of Interest Code as required by the Political Reform Act.

Body

DISCUSSION:

The Political Reform Act (Government Code Sections 81000 et seq.) requires all cities to adopt a Conflict of Interest Code identifying designated positions of City officers, officials, representatives, and employees that must publicly report specified financial information.

Effective January 1, 2026, all 87200 Filers, defined by California Code Section 87200, are required to file with the Fair Political Practices Commission (FPPC). Furthermore, the recently enacted Senate Bill 852 added public officials who manage public investments to the list of individuals for whom the FPPC is also the filing manager. Those public officials must file their statements of economic interest using the Commission's electronic filing system.

Requirements for designation to particular “Disclosure Categories” are either contained specifically in the Government Code or in the City’s Conflict of Interest Code. Biennial updates are required to reflect organizational changes such as the reorganization of departments, creation of new positions, significant changes in duties, or the elimination of job titles/classifications.

Both existing and newly created positions were reviewed to update the Code to applicable disclosure categories, and job classifications that have been eliminated over the past two years have been removed. Revisions were reviewed and submitted by City Department Heads.

The City’s first Conflict of Interest Code was adopted September 20,1976 by Resolution 76-227 and has been updated every two years since that time.

FINANCIAL IMPACTS:

None.

CEQA:

The City Clerk has determined that the recommended action described in this agenda report is not subject to CEQA, pursuant to CEQA Guidelines Section 15378.
