Adopt a resolution: (1) approving and authorizing the Public Works Director to award a construction contract to, and execute a construction contract with, Imperial Construction & Engineering, Inc. for the City Parking Lots Repairs project in the bid amount of $326,082.22; (2) authorizing the Public Works Director to approve change orders and charges for project services up to $170,520 for a total project construction amount not to exceed $496,602.22; (3) amending the FY2025/26 & 2026/27 Capital Improvement Project Plan as documented in Council Budget Amendment No. 7P3; and (4) determining that the actions authorized by this resolution are exempt from CEQA.

DISCUSSION:
The City Parking Lots Repair Project includes repaving the parking lots serving the Police Department, City Hall, and Fire Station No.1. The Project also includes installation of a new security fence and gate between Fire Station No. 1 and the Police Department and upgrading badge reader access at the existing gate into the Police Station's back lot. The new fence and gate between the fire and police buildings will provide additional security for patrol vehicles and limit public access to the back side of the fire station. A grant received from the City's risk pool, PRISM, will fund a portion of the new fence and gate.
The engineer's estimate of probable construction cost for the Project is $358,000.
Staff publicly bid the Project during the month of August. On September 2, 2025, five (5) formal bids for construction were received. The bids were as follows:

During the bid review, staff observed the apparent low bid was substantially lower than the others. Staff contacted the lowest bidder, who confirmed they are prepared to complete the work for the submitted bid price.
The Napa Municipal Code local businesses preference of a three percent (3%) bid reduction factor did not alter the bid results.
The construction budget is proposed as follows:
Imperial Construction & Engineering, Inc. $326,082.22
Contingency for unforeseen conditions (25% of bid) $ 81,520.00
Construction Management and Inspection $ 65,000.00
Public Works Engineering Staff $ 10,000.00
Materials Testing (Consultant) $ 14,000.00
Total $496,602.22
The contingency, contract administration, construction management, inspection costs, and geotechnical testing are estimates. The funds can be used interchangeably between the items listed above.
Sufficient funding for the Project is available under two CIP accounts. One was created for the parking lot resurfacing and one was created for the gate project. The proposed budget transfer will consolidate the two CIP accounts into one CIP account and transfers are described in the financial impact section.
FINANCIAL IMPACTS:
Sufficient funding is available in 1) the Surface Repair City Parking Lots project (33FC24PW06) and 2) PD Admin Parking Lot Gates (33FC24PD01). Staff recommends consolidating the two projects into a single project (33FC24PW06) by amending the FY2025/26 & 2026/27 Capital Improvement Project Plan as documented in Council Budget Amendment No. 7P3 including the following changes:
a. De-obligate $22,592.00 of PRISM Grant funds from PD Admin Parking Lot Gates (33FC24PD01); and
b. De-obligate $71,137.46 of City Facilities Reserve funds from PD Admin Parking Lot Gates (33FC24PD01); and
c. Obligate $22,592.00 of PRISM Grant funds to Surace Repair City Parking Lots Project (33FC24PW06); and
d. Obligate $71,137.46 of City Facilities Reserve funds to Surace Repair City Parking Lots Project (33FC24PW06); and
e. Change the status of PD Admin Parking Lot Gates (33FC24PD01) from "Active" to "Closed"
CEQA:
City staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15301(d), which exempts the restoration or rehabilitation of existing deteriorated or damaged structures, facilities, or mechanical equipment.
