Approve the second reading and adoption of an ordinance enacting Napa Municipal Code Chapter 5.82, establishing a sidewalk vending permit system, operational regulations, and enforcement provisions consistent with Senate Bill 946.

DISCUSSION:
This is the second reading and final adoption of an ordinance enacting Napa Municipal Code Chapter 5.82, which will establish a clear framework to manage sidewalk vending. This ordinance protects pedestrian access, emergency routes, and public spaces by setting objective rules and standards for vendors.
The introduction and first reading of the ordinance was held at the Regular City Council meeting on July 21, 2026. If approved the ordinance will become effective thirty days following adoption.
FINANCIAL IMPACTS:
The Ordinance is expected to improve administrative efficiency by establishing a clear permitting and enforcement structure. No significant fiscal impacts are anticipated.
CEQA:
The Community Resources & Development Director has determined that the Ordinance does not qualify as a Project subject to CEQA under State CEQA Guidelines Section 15378 and is otherwise exempt from CEQA under State CEQA Guidelines Section 15061(B)(3).
