Approve and authorize the City Manager to execute on behalf of the City Amendment No. 2 to Agreement No. C2024-697 with Best Best & Krieger LLP (“BBK”) in the increased amount of $475,000 for a total contract amount not to exceed $1,300,000

DISCUSSION:

Following the resignation of the former Interim City Attorney effective September 2024, the City Council authorized the City Manager to negotiate a professional services agreement with Best Best & Kreiger LLP (“BBK”) for legal services in the amount of up to $350,000. The Council also appointed Christopher Diaz of BBK as the Interim City Attorney effective September 7, 2024. On February 18, 2025, Council approved Amendment No. 1 to Agreement No. C2024-697, increasing the amount not to exceed to $825,000.

 

Mr. Diaz has served in the Interim City Attorney capacity since that time and additional legal services from BBK have been engaged as needed to ensure legal needs are sufficiently met.

 

The proposed Amendment No. 2 to Agreement No. C2024-697 increases the not to exceed amount to $1,300,000 which provides sufficient contract capacity to allow the City to continue engaging Mr. Diaz and BBK services while the City pursues selection of a permanent City Attorney.

 

FINANCIAL IMPACTS:

The City Attorney’s Office budget has sufficient capacity to absorb the increased costs of the contract amendment.

 

 

CEQA:

The City Manager has determined the recommended actions described in this staff report are not subject to CEQA, pursuant to CEQA Guidelines Section 15060 (c).
