Recommendation
Adopt a resolution 1) accepting Amended and Restated Grant of Easement and Agreement from the Napa Valley Community College District for water facilities, and 2) authorizing the Utilities Director to execute a certificate of acceptance for the Amended and Restated Grant of Easement and Agreement and record said deed at the Napa County Recorder’s Office, and determining that the actions authorized by this resolution are exempt from CEQA.

DISCUSSION:
Napa Valley College in coordination with the Napa Valley Transportation Authority (NVTA) constructed a pedestrian walkway and retaining wall (Project) on the College property (APN 046-450-004). A portion of the Project includes constructing improvements located within a 1951 City easement for an existing 24-inch steel transmission water main. Napa Valley College and NVTA agreed to amend and restate the 1951 easement to grant to the City a non-exclusive and perpetual easement for continued access for installation, maintenance, operation and repair of the City’s Transmission main while identifying responsibilities for replacement of the Project improvements in the event they conflict with City work within the easement.
The amended and restated easement was approved by the Napa Valley College Board meeting on June 13, 2024.
FINANCIAL IMPACTS:
Acceptance of the subject Amended and Restated Grant of Easement and Agreement from the Napa Valley College will have no financial impact to the City.
CEQA:
City Staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15301(b) which exempts minor alteration of existing utilities to provide water, electric power, natural gas, sewerage, or other public utility services.
