Adopt a Resolution authorizing overtime portal to portal pay for non-exempt employees in the Fire Department, and overtime rate for exempt employees in the Fire Department, as reimbursed by the State of California Governor’s Office of Emergency Services.

DISCUSSION:

From time to time, City of Napa Fire Department personnel provide support during emergency responses coordinated by the California Governor’s Office of Emergency Services (CalOES). The City receives reimbursement for these services through the California Fire Assistance Agreement (CFAA), which governs the terms for Master Mutual Aid deployments across California and, in some cases, nationally.

 

Under the CFAA, the City of Napa has consistently paid its non-exempt employees (represented by the Napa City Firefighters’ Association) on a portal-to-portal basis beginning from the time they leave until they return to the City. Exempt employees (represented by the Napa Chief Fire Officers) are also compensated at the overtime rate when such reimbursement is provided by CalOES or FEMA.

 

CalOES identified instances where some agencies were not compensating employees at the rates billed for reimbursement. In response, federal and state agencies now require participating jurisdictions to formally confirm, through an adopted resolution, that they pay overtime as appropriate and compensate employees portal-to-portal. This resolution affirms the City of Napa’s compliance with these requirements, reflects long-standing City practices, and aligns with the provisions of the Memoranda of Understanding with both the NCFA and NCFO.

 

FINANCIAL IMPACTS:

There is no financial impact associated with this action. The City of Napa has always

paid portal to portal for its non-exempt employees and at the overtime rate for exempt

employees when being reimbursed by CalOES.

 

CEQA:

The City Manager has determined that the Recommended Action described in this Agenda Report is not subject to CEQA, pursuant to CEQA Guidelines Section 15378.
