Adopt a resolution: (1) approving and authorizing the Public Works Director to award a construction contract to, and execute a construction contract with, MARC Builders LLC, for the Soscol Median Public Art Project in the bid amount of $264,478; (2) authorizing the Public Works Director to approve change orders and charges for project services up to $71,448 for a total project amount not to exceed $335,926; and (3) determining that the actions authorized by this resolution are exempt from CEQA.

DISCUSSION:
In 2018, medians along Soscol Avenue between Gasser Drive and Sousa Lane were constructed to enhance safety and improve traffic flow along the corridor as part of a private development project. Developing a public art project for the Soscol Avenue medians was identified as a priority under the Roadway Category of the Public Art Master Plan. The Soscol Medians public art project was recommended by the Public Art Steering Committee (PASC) and approved by City Council in April 2022. The south Soscol Avenue corridor is significant within the City of Napa as it serves as an entry roadway into the City from Highway 221/121. The artwork “Downstream” by the artist Jacques Lesec was approved by City Council in August 2023. The funding to complete the public improvements ancillary to this project, as described in this Staff report, will come from the Arterial/Gateway Enhancement Project (33MS17PW01).
The Project consists of site preparation for the upcoming installation of “Downstream” art pieces within the median areas of Soscol Avenue between Gasser Drive and Sousa Lane. The work includes construction of structural footings to mount the art pieces, decorative pavement to fill in the medians, electrical conduit, wires to power LED lights that will illuminate the artwork, and necessary temporary traffic control to complete the work.
The engineer’s estimate of probable construction cost for the Project is $239,910.
Staff publicly bid the Project during the month of September 2024. Bids were due on September 19, 2024, and zero (0) formal bids for construction were received.
Section 101 of the City Charter allows for direct negotiation of construction projects when no formal bids are received: “In case no bid is received, the City Council may likewise provide for the work to be done by the proper department or the supplies to be purchased in the open market.”
Public Works engineering staff reached out to three contactors and were able to negotiate the proposed construction contract and determined the costs are reasonable for the work required.

The contingency, contract administration, construction management, inspection costs, and geotechnical testing are estimates. The funds can be used interchangeably between the items listed above.
FINANCIAL IMPACTS:
There are no additional financial impacts. There is sufficient funding for the Project in the Arterial/Gateway Enhancement Project (33MS17PW01) adopted in the current CIP Budget.
CEQA:
City staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15301(c) (minor alteration of existing streets and sidewalks).
