Adopt a resolution authorizing the Fire Chief to execute on behalf of the City a Joint Powers Agreement for Fire Services with Napa County and American Canyon Fire Protection District.

DISCUSSION:

In 2010, the City and American Canyon Fire Protection District (“District”) entered into a Joint Powers Agreement (“JPA”) which enabled both parties to share functions of supervision of operations, training, fire prevention, administration, and disaster preparedness on an as-needed basis. Recognizing the benefits of resource sharing and collaboration for the purposes of enhancing fire protection and emergency response services (“Fire Services”), both parties saw value in expanding the JPA to include Napa County Fire.

 

In the event one of the parties does not have sufficient staffing, equipment, and/or other resources to perform, support, or enhance their services in their respective boundaries and service areas, the JPA gives them the ability to seek the assistance of another to meet those needs. Fire Services may be provided by one or more Parties to another Party participating on a case-by-case basis, and upon agreement between the respective fire chiefs. Any proposed agreement outside of the definition of “Fire Services” contained herein, or that may result in a significant, ongoing impact to city resources or operations would be handled by separate agreement.

 

Nothing contained in the proposed JPA is intended to alter or replace language specific to existing Mutual Aid, Automatic Aid, Assistance by Hire (“ABH”), or other agreements between participating agencies. These agreements exist to provide and/or facilitate specific emergency response or staffing assistance between agencies, but in an emergency setting and context. The proposed JPA is intended to facilitate resource sharing outside of the specific purposes and parameters of those agreements.

 

FINANCIAL IMPACTS:

This JPA will not have a financial impact as the Requesting Party shall pay the Assisting Party for all costs incurred by the Assisting Party in providing services to the Requesting Party. Compensation for staff time shall be the then-current fully burdened overhead rate (the “Fully Burdened Overhead Rate”) for the Assisting Party’s employee performing the services.

 

CEQA:

The Fire Chief has determined that the Recommended Action described in this Staff

report is not subject to CEQA, pursuant to CEQA Guidelines Section 15060(c).
