Recommendation

 

Adopt a resolution: (1) authorizing the Public Works Director to award a construction contract to, and execute a construction contract with, TPM Construction, Inc., for the Las Flores Community Center Upgrades Project (33FC22PW03) in the bid amount of $2,258,000; (2) authorizing the Public Works Director to approve change orders and charges for project services up to $610,800 for total project construction costs amount not to exceed $2,868,800 and (3) determining that the actions authorized by this resolution are exempt from CEQA.

DISCUSSION:

The Las Flores Community Center, located at 4300 Linda Vista Ave in northwest Napa, serves all of the Napa community by providing recreational space for sports leagues, sports camps, open gym, preschool programs, and community reservations.  This is the sole indoor community recreational facility offered by the City of Napa. Existing spaces include (1) indoor gymnasium, (1) preschool classroom, (1) kitchenette, (1) customer service counter and (1) office space. Additionally, surrounding the facility, exterior recreational amenities include (1) tennis court, (4) pickleball courts, (1) playground, and passive pathways and turf areas. The facility was built over thirty years ago and is due for improvements to meet current standards and needs of the community.

 

Measure G is an important funding source for this project and is contributing $1,800,000 for the construction phase of the work. The project scope consists of accessible (American Disability Act-ADA) site improvements and renovations to the building facility including the entryway, gymnasium, hallways, restrooms, kitchenette, and classroom. The gymnasium will receive a new ADA-accessible sports floor, new scoreboard, new wall-mounted basketball hoops, and acoustic treatments. The project replaces outdated fluorescent and HID fixtures with new energy efficient LED lighting throughout the interior and exterior. Exterior improvements will address ADA needs such as accessible curb ramps and walkways, as well as to small-scale recreational features that provide overhead shade and UV protection in seating areas and access to a water fountain for the preschool program attendees, sports court users, and the general public. New drought-tolerant, native landscaping and irrigation around the building is also included in the scope to reduce long-term City water usage and improve aesthetics.

 

The engineer’s estimate of probable construction cost for the Project is $2,880,800. Staff publicly advertised the Project on September 18, 2025.  On October 20, 2025, sixteen (16) formal bids for construction were received.  The bids were as follows:

One of the bids submitted lacked the required bid bond and absence of a bid bond is an automatic non-waivable disqualification by law.  Napa Municipal Code Section 2.93.040 requires the City apply a three percent (3%) bid reduction factor to qualified local businesses as part of the competitive bidding process. The bid amount submitted by JDR Development Co, Inc., a Napa business, was $2,264,137 and was initially identified as the second lowest bidder. The 3% bid reduction would have moved JDR Development into the lowest position among bidders. However, JDR Development did not submit the required bid bond documents with their bid. A bid protest was submitted by the lowest bidder, TPM Construction Inc., referencing the bid bond omission. The absence of a bid bond is an automatic non-waivable disqualification, leaving TPM Construction, Inc. of Dixon, CA as the lowest and best bidder.

The contingency, construction management and inspection costs, materials testing, and staff time are estimates.  The funds can be used interchangeably between the items listed above.

 

FINANCIAL IMPACTS:

There are no financial impacts. Sufficient funding for the Project is composed of existing appropriations for the Las Flores Community Center Upgrades Project (33FC22PW03) adopted in the current CIP Budget from a combination of Measure G, Parks and Recreation Quadrant Funds, and Capital Improvement Facilities Reserve Funds.

 

CEQA:

City staff recommend that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15301(d), which exempts the restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety.
