Adopt a resolution (1) approving and authorizing the Public Works Director to execute contracts with 4 Brothers Trucking LLC and USA Trucking Inc. for task order-based trucking services in an amount not to exceed $1,500,000 each; and (2) determining that the actions authorized by this resolution are exempt from CEQA.

DISCUSSION:

Trucking services are a necessary component of the City’s ongoing street paving operations and are critical to maintaining paving schedules. Working alongside City Operations crews, contracted trucking services are used to remove asphalt grindings from project sites and deliver hot mix asphalt to job sites to support continuous and efficient paving operations. The trucks provided through these contracts have greater hauling capacity than City-owned vehicles, allowing larger quantities of material to be transported per trip.  This improves operational efficiency, reduces the number of trips required to complete work, and lowers associated fuel use and emissions.

 

The Utilities Department’s Water Division also utilizes trucking services to transport sludge byproducts generated from the water treatment process for proper disposal.  In addition, other City operations, including Streets, Utilities, and Parks maintenance activities, may use trucking services provided under the proposed agreements on an as-needed basis.

 

To support the current and planned Street Paving Program workplan, as well as ongoing water treatment operations for the next three years, staff issued a Request for Proposals (RFP) for trucking services on January 23, 2026. Proposals were received on February 13, 2026, from the following firms: 4 Brothers Trucking LLC, Benjamin’s Transfer Inc., Bray Trucking Inc., Golden State Trucking Services, Inc., Toby’s Trucking Inc., and USA Trucking Inc.

 

Following receipt of the proposals, staff evaluated and scored each proposal based on general qualifications, experience, price, proposed scope of services, staffing, and available equipment. The evaluation was conducted in accordance with the criteria set forth in the RFP, and the recommended award represents the best overall value to the City. Based on this evaluation, staff determined that 4 Brothers Trucking LLC and USA Trucking Inc. represented the best proposals, based on the following factors:

 

                     4 Brothers Trucking LLC submitted the most competitive pricing and received the highest overall evaluation score. They are based in Pittsburg, CA.

                     USA Trucking Inc. received the second-highest overall score.  They are based in Antioch, CA.

 

Consistent with applicable legal standards, including Graydon v. Pasadena Redevelopment Agency (1980), it was determined that a traditional low-bid procurement process is not well suited for these services. The City’s need for trucking services is variable and operationally driven, with work assigned on an as-needed basis that cannot be fully defined through a fixed scope of work. Utilizing a task order-based, on-call contracting approach provides the flexibility necessary to respond to changing operational demands, maintain continuity of services, and secure qualified trucking resources when needed.

 

Staff recommends awarding two on-call contracts, each in an amount not to exceed $1,500,000, to 4 Brothers Trucking LLC and USA Trucking Inc.  Under on-call contracts, task orders are issued specifying the scope of services required, schedule, and maximum payment per task.  There is no commitment that the full contract amounts will be utilized.  Both agreements require compliance with prevailing wage requirements and Department of Industrial Relations (DIR) regulations.

 

FINANCIAL IMPACTS:

Funding for the proposed agreements is included in the Paving Program (30230810) and the Water Treatment Division (53060116) budgets for Fiscal Year 2026/27. Costs in Fiscal Year 2027/28 and 2028/29 will be addressed through future budget appropriations approved by City Council.

 

CEQA:

Staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15301, which exempts the operation, maintenance, and repair of existing public facilities involving negligible or no expansion of existing use.
