(2) Adopt a resolution obligating $250,000 of Public Art funds for Soscol Median Public Art Project (PA22PR04), as documented in Budget Adjustment No. BE2204502.

DISCUSSION:
The City adopts a 5-year Capital Improvement Plan (CIP) to plan and program resources necessary for the acquisition, design, and/or construction of significant City projects. The CIP projects repair or develop community infrastructure or meet community needs, provide facilities to support City operations, and support City Council priorities.
A capital project is considered a one-time expenditure but often the projects take multiple years to deliver and fully fund. While plans are developed for at least a 5-year horizon, funding for the projects within the CIP is approved by Council as part of the budget process, or project funding can be approved by a separate City Council action when funding adjustments are necessary outside the normal budget cycle approval process.
The project requests for the upcoming year were much greater than funding available, particularly for General Fund projects. Staff has worked together on the proposed plan to program the limited funding to finish projects that have already been started, repair and maintain existing infrastructure, and to leverage City funding through external grants and improving efficiencies. The proposed CIP funding plans are attached.
The Soscol Median Public Art Project (PA22PR04) is proposed to receive a $250,000 obligation of Public Art Funds in Fiscal Year 2021-2022. Public Arts funds will be limited to procurement of the services of a professional artist; the additional funding proposed will support the completion of public improvements ancillary to the artist’s installation.
The presentation will focus on projects proposed for funding in Fiscal Year 2022-2023.
FINANCIAL IMPACTS:
The proposed Capital Improvement Program for the 2022-2023 budget cycle contains 64 projects, is funded by multiple funding sources intended for Capital projects, and totals $41,478,048. The 5-Year Capital Improvement Program plan for FY 2022-23 through FY 2026-27 is funded by multiple funding sources intended for Capital projects and totals $169,848,048. The proposed budget adjustment would obligate $250,000 from the Public Art Fund (GL 21701) to the Soscol Median Public Art Project’s (PK22PA04) FY22 Budget.
CEQA:
The Public Works Director has determined that the Recommended Action described in this Agenda Report is not in-and-of-itself a “project” (pursuant to CEQA Guidelines Section 15378) since it does not result in a physical change in the environment.
However, the Recommended Action is a part of a larger “project” that will be subject to environmental review in accordance with CEQA at the “earliest feasible time” prior to “approval” consistent with CEQA Guidelines Sections 15004 and 15352. The larger “project” is future Capital Improvement Projects, and staff plans to bring back a CEQA analysis of each project to Council prior to approval of each project.
