Recommendation

 

Adopt a resolution authorizing the summary abandonment of a portion of a Storm Drainage Easement superseded by relocation affecting a portion of property located at 535 Coombsville Road (APN 046-011-021) for the Napa Courtyards Project (Project No. ENG18-0001), and determining that the actions authorized by this resolution are exempt from CEQA.

DISCUSSION:

Napa Pacific Associates is the owner of real property located at 535 Coombsville Road in Napa and is also the applicant and developer of the Napa Courtyards project (“Project”) located on that property.

 

The Project is a 20-unit affordable housing development that was approved by the City in February 2016.  The development site has a portion of a storm drain line and easement running through the center of the property pursuant to that certain easement granted to the City and recorded September 11, 1970 in Volume 835, at page 111, Napa County Official Records (the subject portion of the easement is identified as Parcel One of the Grant of Easement and hereafter identified as the “Subject Easement”).

 

The location of the Subject Easement conflicts with the development of the Project, so one of the conditions of the Project was to relocate the existing storm drain line and associated easement rights to the western perimeter of the property, outside the footprint of the development.

 

The Project is now complete, the storm drain line was relocated, and the new easement in the alignment of the relocated storm drain line has been granted to and accepted by the City.  The final step to fulfill the development condition is to abandon the Subject Easement.

 

Abandonment of the Subject Easement qualifies for a summary abandonment under Section 8333(c) of the California Streets and Highways Code because the subject easement has been superseded by relocation.  A public hearing is not required under the procedures for a summary abandonment.

 

FINANCIAL IMPACTS:

There is no financial impact to the City of Napa anticipated as a result of the proposed action.

 

CEQA:

City staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15301 (minor alteration of existing facilities).
