Approve and authorize the Public Works Director to execute on behalf of the City an amendment to Agreement No. C2020-116 with National Plant Services, Inc., for the Storm Drain Infrastructure Condition Assessment in the increased amount of $200,000 for a total contract amount not to exceed $1,575,000.

DISCUSSION:
The City entered into a contract with National Plant Services (NPS) in 2020 to conduct a Storm Drain Infrastructure Condition Assessment. NPS was selected through a competitive proposal process. The agreement has been amended four times as funding became available to extend the services to assess additional sections of the City storm drain system. To date, NPS has inspected, video documented and rated 136,700 feet of pipe (over 25 miles) and 980 manholes/catch basins and inlets. This represents approximately 28% and 41% of the City’s pipe and structures respectively. Additionally, NPS has removed debris and cleaned over 86,000 feet of pipe.
The results of the assessment completed to date determined 21% of the pipe segments reviewed had major defects, blockages, and/or pipe wall failure/blocked. Another 25% of the pipes assessed had structural defects, obstructions and/or deposits. The results are being used to develop prioritized projects to clear obstructions, rehabilitate and replace the storm drain infrastructure. Over $3 million has been programmed to make repairs under a separate capital improvement program (CIP) project scheduled for 2025.
Proceeding with the condition assessments for the storm drain system is critical to identify deficiencies so that plans can be developed to address damage prior to major system failures. Major system failures can result in extensive damage to surrounding infrastructure and property. This proposed amendment will complete the assessment for additional storm drainage facilities. The combination of the original contract and amendments will result in approximately 35 to 40% of the total system being evaluated.
FINANCIAL IMPACTS:
The funding is available through the American Rescue Plan Act (ARPA) funds that have been specifically programmed for storm drain assessments and repair (33SD23PW01). There is no General Fund impact.
CEQA:
The Public Works Director has determined that the Recommended Action described in this Agenda Report is not in-and-of-itself a “project” (pursuant to CEQA Guidelines Section 15378) since it does not result in a physical change in the environment. It is also exempt pursuant to CEQA Guideline 15301 as the maintenance of existing facilities which is specifically defined in the CEQA Guidelines to include the maintenance of existing utility lines. Finally, it is also exempt pursuant to CEQA Guideline 15306 as information collection regarding the existing condition of the City’s storm drain system that will eventually lead to a future repair project(s) that the City has not yet approved, adopted, or funded.
However, the Recommended Action is part of larger “projects” that will be subject to environmental review in accordance with CEQA at the “earliest feasible time” prior to “approval” consistent with CEQA Guidelines Sections 15004 and 15352. The larger “projects” are repair/replacement of storm drains, and staff plans to bring back a CEQA analysis of those projects to Council prior to award of construction contracts.
