Adopt a resolution authorizing the grant of two easement grant deeds to the Napa Sanitation District for sanitary sewer easements over portions of City-owned property at Kennedy Park (APNs 046-450-037 and 046-450-062), and determining that the actions authorized by the resolution are exempt from CEQA pursuant to CEQA Guidelines Section 15301(b).

DISCUSSION:
The City owns property known as Kennedy Park, including portions of Streblow Drive identified as Assessor Parcel Numbers 046-450-037 and 046-450-062. Existing sanitary sewer facilities serving the Napa County Re-entry facility and the new Napa County jail facility are located within portions of these parcels. Easements accommodating the sewer line within portions of Streblow Drive and Kennedy Park were granted to the County of Napa in June 2019.
The Napa Sanitation District (NSD) will be taking over ownership and maintenance of the sewer line from Napa County. To formally establish rights for access, operation, maintenance, and repair of the sewer facilities, NSD has requested the grant of two permanent sanitary sewer easements. One of the easements crosses both APNs 046-450-037 and 046-450-062 and has been prepared to include an extinguishment clause, providing that the easement will terminate if the easement area is formally dedicated to and accepted as a public street right-of-way. The easement area currently sits within portions of Streblow Drive within Kennedy Park and is currently a private roadway situated on City owned property. The second easement is only located within portions of APN 046-450-037 and will remain permanent.
The proposed easements will provide NSD with the legal authority to enter upon the easement areas for the purpose of maintaining and servicing its infrastructure. Each easement is described and depicted in the legal descriptions and plat maps attached as Exhibits “A” and “B” to the respective easement grant deeds.
FINANCIAL IMPACTS:
There is no financial impact to the City of Napa anticipated as a result of the proposed action.
CEQA:
City staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15301(b) (minor alteration of existing facilities).
