DISCUSSION:
Existing law generally prohibits the possession or consumption of alcoholic beverages on public school property; however, there are some exceptions to this prohibition within the law. (see California Business and Professions Code Section 25608.) One of these exceptions allows the possession or consumption of wine that is produced by a bonded winery owned or operated as part of an instructional program in viticulture or enology.
SB 228, introduced by Senator Dodd and coauthored by Assembly Member Agular-Curry, would add another exception to this general rule, to authorize the possession and consumption of beer produced by a bonded craft brewery owned or operated as part of an instructional program in craft brewing. Senator Dodd's office has requested that Council authorize the Mayor to send a letter in support of SB 228.
California has numerous institutional craft brewing programs which offer hands-on brewing science instruction including malting, mashing, brewing, and fermentation and finishing of the product. Currently students enrolled in craft brewing educational courses must discard any product produced the program.
In accordance with Council Policy Resolution No. 31, since City Council has not previously identified a City goal, objective or interest in support of the programs intended to benefit from SB 228, staff recommends that City Council consider responding to the request from Senator Dodd's office by authorizing the Mayor to send a letter in support of SB 228.
