Authorize the Police Chief to execute Amendment 4 to Agreement C2013 11 with Data Ticket, Inc., to process requests from indigent persons for payment plans for parking violations, in compliance with recent changes to the California Vehicle Code.

DISCUSSION:
The City of Napa has been utilizing Data Ticket, Inc. for citation processing and collection since January 20, 1995. As State law governing parking regulations (primarily set forth in the California Vehicle Code) is amended, Data Ticket offers services to adhere to those laws. On October 13, 2017 the State of California enacted Assembly Bill 503, which amended California Vehicle Code Sections 4760, 21107.8, 40215, and 40220, and which requires changes to the City's processes for processing parking citations effective as of July 1, 2018. The changes made by AB 503 require the City to allow any person who receives a parking ticket the ability to request a payment plan for the payment of the parking ticket charges if the person qualifies as indigent. The bill requires the person to provide specified information related to their income or receipt of benefits under certain social services programs in order to qualify as indigent.

Data Ticket offers the service of evaluating indigent applications and will accept or deny indigent applications based on criteria set forth by Assembly Bill 503. The attached Amendment 4 will authorize Data Ticket, on behalf of the City, to accept or deny these requests and provide collection services if a payment plan is established.

FINANCIAL IMPACTS:
Requests for payment plans will not reduce the fine amounts but will delay the receipt of the full fine in some cases. The funds required for Amendment 4 have been budgeted in...
