Determine there is a need to continue the emergency action to perform the Emergency Storm Drain Repair of Minahen Street, Locust Street and Solano Avenue, and determine that the actions authorized by this item are exempt from CEQA.

DISCUSSION:

Pursuant to City of Napa Municipal Code 2.91.040, City Staff shall continue to make reports to City Council at each regularly scheduled City Council meeting until the emergency action is terminated by the City Council.  City Council heard an Administrative Report at the August 21, 2018, Council meeting and determined the need to continue the emergency.

 

Since the last report on November 13, 2018, the storm drain repairs on Minahen and Locust Streets have progressed as follows: All the Snap-Tite pipe has been inserted into the old corrugated-metal pipe and grouting work for the annular space between them has been completed.  The new pipes are installed and functioning now that it is raining.  Work to be completed consists of finishing manholes, some piping and backfilling various trenches, etc. 

 

City staff met with contractor to evaluate project status, construction issues identified by the contractor, and scope of required work revisions as related to original scope and project budget in an effort to bring the project to an equitable closure. 

 

Emergency Determination:

On August 10, 2018, based on a recommendation from the Deputy Public Works Director, as summarized in this report, the City Manager determined that the storm drain failures at Minahen Street, Locust Street, and Solano Avenue required immediate action to resolve an emergency, including entering into contracts for the purchase of pipe materials and performance of repairs.

 

Emergency Contract and Materials Procurement:

The current situation was declared an emergency by the City Manager pursuant to City of Napa Municipal Code, Title 2 Personnel and Administration, Chapter 2.91 Contracting Ordinance, 2.91.040 Exceptions for Emergency Contract Procurements, and Public Works was directed to procure the materials and begin the repairs before the next sink hole appears.  Public Works staff identified the necessary storm drain pipe and method to repair the failing system and found a local contractor with the skill, experience and availability to perform the installation of the pipe and conduct the necessary repairs. 

 

Public Works staff reached out to the local contracting community and determined that G.D. Nielson Construction, Inc. has the necessary equipment and personnel with the skill and experience needed to perform the repairs.  Nielson Construction agreed to take on the project and will be completing the work in a timely manner.  The contract for Nielson for the pipe installation and grout repair Minahen / Locust Streets is Time and Materials estimated at $290,000 and Solano Avenue, Time and Materials estimated at $70,000.  At the August 21, 2018 meeting, Council also authorized an additional $200,000 to be available for any unforeseen circumstances, but it will not be used unless absolutely necessary.

 

FINANCIAL IMPACTS:

There are no financial impacts to report at this time.

 

CEQA:

City staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15302 which exempts the replacement and reconstruction of existing utility systems/facilities involving negligible or no expansion of capacity.
