Adopt a resolution approving the 2019 Annual Fire Inspection Compliance Report prepared pursuant to California Health and Safety Code Sections 13146.2 - 13146.4 (SB 1205).

DISCUSSION:

California state law requires that all fire departments and districts in the state conduct annual safety inspections of all public and private schools, apartments, condominiums, hotels, and motels within their jurisdiction(s). Recognizing that this law did not require local compliance reporting of such inspections, a new state law, SB 1205 (Hill) was enacted in January 2019, requiring all fire departments to submit annual reports to their governing bodies or administering authorities regarding their compliance with these state mandated fire inspections. These state law requirements are codified at California Health and Safety Code Sections 13146.2 through 13146.4.

Due to short staffing during calendar year 2019, all of the Department’s State mandated inspections for 2019 were not completed as required by Health and Safety Code Sections 13146.2 and 13146.3. The Department inspected 644 of the 705 buildings it is required to inspect, or 91.3%.  Some occupancies did not receive their initial inspections and will be given priority for inspection in 2020. The 2019 Inspection Compliance Report is attached (Exhibit A to Attachment 1).

 

FINANCIAL IMPACTS:

No direct financial impacts.

 

CEQA:

The Fire Chief has determined that the Recommended Action described in this Staff report is not subject to CEQA pursuant to CEQA Guidelines Section 15060.
