Authorize the City’s voting delegate at the Cal Cities Annual Conference Business Meeting, on September 24, 2021, to vote in favor of two proposed Cal Cities resolutions: (1) call on the State Legislature to pass legislation that provides for a fair and equitable distribution of the Bradley Burns 1% local sales tax from in-state online purchases; and (2) to call on the Governor and the State Legislature to work with Cal Cities to provide adequate regulatory authority and necessary funding to assist cities with railroad right-of-way areas to address illegal dumping, graffiti, and homeless encampments that proliferate along the rail lines and result in public safety issues.

DISCUSSION:
The League of California Cities (“Cal Cities”) will hold its Annual Conference September 22 -24, in the City of Sacramento. At the Annual Conference, Cal Cities conducts its Annual Business Meeting where the voting delegate of each Cal Cities Member votes to support or oppose proposed Cal Cities resolutions. These resolutions help guide cities and Cal Cities in efforts to improve the quality, responsiveness and vitality of municipal government in California.
On August 17, 2021, the City Council appointed Vice Mayor Liz Alessio as the City’s voting delegate to represent the City at Cal Cities’ Annual Business Meeting. Councilmembers Beth Painter and Bernie Narvaez were appointed as the alternate voting delegates. A copy of the Cal Cities Voting Delegate Letter submitted on August 18, 2021 to Cal Cities has been provided for reference as Attachment 1.
Cal Cities’ bylaws stipulate that each City is entitled to one vote on matters raised during the Annual Business Meeting. Cal Cities encourages each city council to consider the proposed resolutions and to determine a city position by providing voting direction to their appointed voting delegate in advance of the Annual Business Meeting.
There are two resolutions proposed for consideration, which have been included as Attachment 2 and 3 for reference.
The first resolution calls on the state legislature to pass legislation that provides for a fair and equitable distribution of the Bradley Burns 1% local sales tax from in-state online purchases, based on data where products are shipped to, and that rightfully takes into consideration the impacts that fulfillment centers have on host cities but also provides a fair share to California cities that do not and/or cannot have a fulfillment center within their jurisdiction. This resolution is in line with the City of Napa’s priorities of maintaining an efficient and stable organization and improving our economic development.
The second resolution calls upon the Governor and the Legislature to provide necessary funding for the California Public Utilities Commission (“CPUC”) to fulfill its obligation to inspect and enforce the safety of railroad lines, and to provide adequate regulatory authority and necessary funding to assist cities, to address illegal dumping, graffiti and homeless encampments that degrade the quality of life and result in increased public safety concerns for communities and neighborhoods that abut the railroad right-of-way. This resolution aligns with the City of Napa’s efforts to ensure the places where we live are receiving a high quality of services in order to better maintain our housing and neighborhood areas.
