Approve the second reading and final passage, and adopt an ordinance amending Napa Municipal Code Section 17.52.390 “Recycling/Solid Waste Areas” and determining that the actions authorized by this ordinance are exempt from CEQA.

DISCUSSION:
This is the Second Reading and Final Adoption of an ordinance amending Napa Municipal Code Section 17.52.390 “Recycling/Solid Waste Areas” and determining that the actions authorized by this ordinance are exempt from CEQA. The introduction and First Reading was held at the Regular City Council meeting on November 16, 2021.
Following the November 16, 2021 hearing, staff identified a typo on the proposed ordinance on page 4, forth line from the bottom, which read, “…based either or site constraints…” and has since been corrected, as reflected in Attachment 1, to read “…based on either onsite constraints…”
If approved the Ordinance will become effective thirty days following adoption.
FINANCIAL IMPACTS:
None
CEQA:
At their regular meeting on November 16, 2021, City Council determined that the Recommended Action described in this Agenda Report is exempt from CEQA pursuant to CEQA Guidelines Section 15303, which exempts construction of new, small facilities or structures, and Section 15311, which exempts minor structures accessory to existing commercial, industrial, or institutional facilities.
