Recommendation

 

Determine there is a need to continue the emergency action to execute and implement construction contracts for the replacement of the Oak Street Storm Drain from Franklin Street to Brown Street, and determine that the actions authorized by this item are exempt from CEQA.

DISCUSSION:

Based on the initial evaluation by Public Works engineering staff of the severe damage to the Oak Street Storm Drain and the need to replace the storm drain pipe prior to heavy winter rains, on August 25, 2021, the City Manager determined that the Oak Street Storm Drain replacement required immediate action to resolve an emergency and authorized the Public Works Director to execute emergency contracts. 

 

Pursuant to City of Napa Municipal Code Section 2.91.040, City Staff shall make reports to City Council at each regularly scheduled City Council meeting until the emergency action is terminated by the City Council.  City staff has complied with this obligation by seeking and obtaining City Council approval to continue the emergency work at each regular meeting since the City Manager’s determination, including an initial administrative report on September 7, 2021, and the most recent prior Council action on March 1, 2022, to continue the emergency.

 

Update:  The storm drain replacement for the project has been completed.  As of March 3, 2022, the contractor has one concrete curb ramp and trench paving to complete the contract work.  It is anticipated that all “punch list items” will be complete by the end of the month.  Project close out with final accounting will be completed by end of April.

 

FINANCIAL IMPACTS:

Damage to the Oak Street Storm Drain was identified prior to the adoption of the current CIP budget and funding for the replacement was included as the Road Maintenance Project FY 21/22-Oak Street Emergency Repair (ST22PW01).  A budget adjustment was approved by Council on November 16, 2021, and the project budget has sufficient funds to complete the emergency replacement of the Oak Street Storm Drain.

 

CEQA:

City staff recommends that the City Council determine that the Recommended Action is exempt from CEQA pursuant to CEQA Guidelines Section 15269 (statutory exemption for emergency repairs, in accordance with California Public Resources Code Section 21080(b)(2)); CEQA Guidelines Section 15301 (Categorical exemption Class 1 Existing Facilities), which exempts repair, maintenance, or minor alteration of existing facilities involving negligible or no expansion of use; and CEQA Guidelines Section 15302 (Categorical Exemption Class 2 Replacement or Reconstruction), which exempts replacement or reconstruction of existing facilities on the same site and with the same purpose.  In this case the existing facility is the Oak Street Storm Drain system.
