Find that the City has no objection to Blackbird Vineyard’s petition to modify conditions on their alcoholic beverage license, and direct staff to not file an objection to the Department of Alcoholic Beverage Control.

DISCUSSION:
Pursuant to Business and Professions Code 23803, the Department of Alcoholic Beverage Control (“ABC”) is required to notify local governing bodies of any petition to remove or modify conditions on an alcoholic beverage license.
On April 11, 2022 the City of Napa received notification, as outlined in Attachment 1, that Blackbird Vineyards filed a Petition for Conditional License with the ABC that there shall be no importation of beer or malt beverages.
As per the relevant statute (Business and Professions Code 23803), the “local governing body” (City Council) has thirty (30) days to file written objections (or not), to the requested modification/removal of conditions.
City Planning staff has reviewed the petition, and has no objections to this request. Blackbird Vineyards is a typical wine-related shipping business based out of a home. ABC controls the handling of alcohol and the home business is permitted.

The City Manager has determined that the Recommended Action described in this agenda report is not subject to CEQA, pursuant to CEQA Guidelines Section 15060(c).
