Adopt a resolution: (1) approving and authorizing the Public Works Director to award a construction contract to, and execute a construction contract with, Dutch Contracting, Inc., for the Alston Park Restroom Project in the bid amount of $431,783.41; (2) authorizing the Public Works Director to approve change orders and charges for project services up to $102,678.34 for a total project amount not to exceed $534,461.75; and (3) determining that the actions authorized by this resolution are exempt from CEQA.

DISCUSSION:
The Alston Park Restroom Project will replace the existing temporary portable restrooms at Alston Park with a permanent public restroom connected to utilities. The location of the new restroom will be at the southern entrance of Alston Park (Council authorized Capital Improvement Program (CIP) project #PK18PR02). The project is prioritized for health and safety as the existing temporary restroom facilities are not deemed adequate for the increasingly heavy public use. Alston Park is the second most visited park out of 54 City parks with almost 100,000 visits annually. Permanent restrooms that are connected to water and sewer will ensure that there are adequate facilities and capacity for all Alston Park public uses.
Alston Park is located in Northwest Napa and is made up of 157 acres of passive open space. The park is categorized as a Natural Area and Open Space Park and existing park uses include conservation of natural resources, hiking, biking, horseback riding, nature study, on-leash dog areas, off-leash dog areas, cross-country running, and balloon landing. Alston Park is protected by the Alston Park Conservation Easement and Declaration of Restrictions dated May 31, 1988 by and between the City and the Napa County Land Trust which prohibits development in Alston Park except for development of structures and infrastructure consistent with the permitted recreational, agricultural, and nature study uses of the park, such as public restrooms. Alston Park parcels were previously annexed into Napa Sanitation District’s (NSDs) boundary and sphere of influence in partnership with the Local Agency Formation Commission of Napa County to enable NSD to provide sewer service to the park.
The project scope includes replacing the existing temporary portable restrooms at Alston Park with a permanent public restroom on a concrete pad connected to new sanitary sewer utilities, ADA access to the restroom area, parking lot repaving, and natural trail improvements leading up to the larger area of the park. The new permanent public restroom will be a concrete restroom with two separate single-user, fully accessible flush restrooms that can withstand elements and is vandal resistant. Funding for the public restroom related improvements will be provided by the previously authorized budget allocation for CIP project #PK18PR02. Funding for nature trail improvements will be provided by the City’s existing Alston Park Trust Fund, which can be utilized for trail, drainage and bench improvements.

The engineer’s estimate of probable construction cost for the Project is $381,215.00.
Staff publicly bid the Project during the month of December. On January 22, 2025, eight (8) formal bids for construction were received. The bids were as follows:

The Napa Municipal Code local businesses preference of a three percent (3%) bid reduction factor did not alter the bid results.
The construction budget is proposed as follows:

Contingency for unforeseen conditions (10% of bid) $ 43,178.34
Construction Management and Inspection (Consultant) $ 45,000.00
Public Works Engineering Staff $ 7,000.00
Materials Testing (Consultant) $ 7,500.00
Total $ 534,461.75
The contingency, contract administration, construction management, inspection costs, and geotechnical testing are estimates. The funds can be used interchangeably between the items listed above.
FINANCIAL IMPACTS:
There are no additional fiscal impacts. Sufficient funding for the Project is composed of existing appropriations adopted in the current CIP Budget (PK18PR02) and the Alston Park Trust Fund (Account 23850200).
CEQA:
City staff recommend that the City Council determine that the Recommended Actions are exempt from CEQA pursuant to CEQA Guidelines Section 15303 (new construction or conversion of small structures).
