Adopt a Resolution authorizing members of any City Commission to simultaneously serve on the Measure G Citizen Oversight Committee

DISCUSSION:

On February 4, 2025, the City Council adopted Resolution R2025-010 establishing the Measure G Citizen Oversight Committee which is responsible for reviewing and reporting annually on the receipt and expenditure of revenue from the tax authorized by Napa Municipal Code Chapter 3.14. Additionally, on February 18, 2025, the City Council adopted Ordinance O2025-002 amending the Napa Municipal Code to add a new Chapter 3.15, which formally created the Committee.

 

Council Policy Resolution 10 (R2016-5), which governs the rules of order and procedures for City-established boards, commissions, and committees, at Section 4.5.5, generally prohibits members of City commissions from simultaneously serving on more than one City Commission unless (a) at least one of the commissions is of limited term, and (b) there is no resulting incompatibility of office.  However, Section 4.1 of Council Policy Resolution 10 also allows the City Council to completely modify this restriction for one or more Commissions through the adoption of a resolution.

 

City staff have identified that it may be beneficial to allow members of other City commissions to serve on the Measure G Citizen Oversight Committee. Specifically, individuals with expertise in municipal processes, budgeting, and public finance would bring valuable insight to the Committee’s oversight responsibilities and strengthen overall board governance.

 

The proposed resolution modifies the current restriction on simultaneous service to allow such service without having to establish that at least one commission is of limited term and that there would be no resulting incompatibility of office.

 

Finally, although the City Council will be modifying the current restriction and not imposing a requirement that no incompatibility of office be established, City staff does not believe there will be any incompatibility of office. The Measure G Citizen Oversight Committee is not tasked with directly allocating funds; rather, it is charged with monitoring expenditures and providing recommendations to ensure funds are used in accordance with Measure G’s intent. Furthermore, no other City commission is involved in decision-making regarding the use of Measure G funds, which eliminates the potential for incompatibility.

 

 

Staff recommends that the City Council adopt the attached resolution authorizing members of any City Commission to simultaneously serve on the Measure G Citizen Oversight Committee.

The City Clerk has determined that the recommended action in this agenda report is not subject to CEQA, pursuant to CEQA Guidelines Section 15060(C).
